United States vessel response requirements expands to cover non-tank vessels operating in US navigable waters

On 30 September 2013 the US Department of Homeland Security passed their final rule on Non-tank Vessel Response Plans and Other Response Plans Requirements.

his final rule will come into force on 30 October 2013, and requires owners or operators of non-tank vessels to prepare and submit oil spill response plans, as well as entering into a funding agreement with a pre-approved salvage company/response team within 30 January 2014.

Previously, only tank vessels were required to prepare and submit oil spill response plans. However, in recognition of the significant increase in the quantity of petroleum and petroleum products carried as bunker for fuel and the potential consequences should a mishap result in a tank breach, the rules have now been extended to apply also to non-tank vessels with a size of 400 gross tons or greater, which operates on the navigable waters of the United States.
